The Sedona Conference announced Monday, July 7, that it is forming a working group to focus on data security and privacy liability.
According to the Sedona website, the group will help private and public organizations, including law firms, protect against and respond to data breaches by analyzing trends. It will also “assist attorneys and judicial officers in resolving questions relating to legal liability and damages regarding data breaches.
The group, dubbed Working Group 11, will also write primers.
“The purpose of the primers is not to provide a summary of the laws, it is to identify the practical takeaways from the statutes and case law that have developed,” said co-chair of the Steering Committee behind the working group, Al Saikali, partner at Shook Hardy & Bacon in Miami. “Organizations can use [the primers] to get a better sense of their potential exposure, the existing legal risks, developing trends in civil litigation and statutory liability, and how other organizations have sought to minimize these risks.”
In addition to the primers, the working group will prepare an overview of “reasonable” and “unreasonable” information security measures.
The Steering Committee is designed to “establish the vision, goals, direction and mission” of the working group, said Saikali. The 12-person committee is also co-chaired by Jay Edelson, managing and named partner at Edelson in Chicago. There is no limit to the number of members that WG 11 will recruit. Members traditionally include lawyers, judges, policy makers, security experts, technologists and business leaders.
Steering Committee members include: Linda Clark, deputy counsel of data security and information compliance at Reed Elsevier; Conor Crowley, principal at Crowley Law Office; Corey Dennis, associate counsel and privacy officer at Pharmaceutical Product Development; Patrice Ettinger, chief privacy officer at Pfizer Inc.; Matthew Fitzsimmons, assistant attorney general for the Connecticut Attorney General’s Office in Hartford, Conn.; Serge Jorgensen, CTO of cybersecurity company the Sylint Group; Matthew Meade, partner at Buchanan Ingersoll & Rooney; Kim Peretti, partner at Alston & Bird; Rose Ring, partner at Munger, Tolles & Olson; Drew Sorrell, partner at Lowndes, Drosdick, Doster, Kantor & Reed.
A majority of the group’s meetings will be virtual, according to a press release. However, WG 11 is slated to meet in-person at The Sedona Conference “All Voices” Meeting in New Orleans, La. on November 5-7.
Other Sedona Conference Working Groups include: Electronic Document Retention and Production (Working Group 1), International Electronic Information Management, Discovery and Disclosure (Working Group 6) and patent Litigation Best Practices (Working Group 10), among others. Sedona started its Working Group Series in 2002.
